Terms of Use

These Terms of Use ("Terms") govern your access to and use of the mayday! : personal airspace mobile application ("App") and the website at themayday.app ("Website"), collectively referred to as the "Service". The Service is operated by Mayday ("Mayday", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
Eligibility
You must be at least 13 years old to use the Service. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you may only use the Service with the consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf. By using the Service, you represent and warrant that you meet these eligibility requirements.
Description of the Service
Mayday is a routine management application built around an airspace model. The App allows you to create, track, and manage personal routines, activities, and effort ladders. The Service may include features such as:
- routine creation, tracking, and management
- effort ladder systems (T1 through T5)
- airspace visualization of routine health
- AI-powered routine generation and refinement
- optional cross-device sync via authenticated accounts
- optional subscription-based premium features
- local and push notifications
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
Accounts and authentication
You may use certain core features of the App without creating a traditional account. Anonymous sessions are supported for local-only use.
If you choose to use Sign in with Apple or any other authentication method we offer, you are responsible for maintaining the security of your authentication credentials and for all activity that occurs under your account. You agree to notify us promptly at support@themayday.app if you become aware of any unauthorized use of your account.
We are not liable for any loss or damage arising from your failure to protect your account credentials.
Subscriptions and billing
Certain features of the Service may require a paid subscription. Subscriptions are billed through the platform app store (such as the Apple App Store) and managed via RevenueCat.
- subscription pricing and terms are displayed in the App at the time of purchase and are subject to change
- subscriptions automatically renew unless you cancel before the end of the current billing period
- cancellation takes effect at the end of the current billing period; you retain access to premium features until the period expires
- refunds are handled by the platform app store according to its refund policies; we do not process refunds directly
- we reserve the right to change subscription pricing; any price change will take effect at the start of the next billing period after notice is provided
You are responsible for any applicable taxes associated with your subscription. We do not receive your full payment card number.
User content and data
"User Content" means any data, text, routines, notes, activity logs, or other information you create, enter, or store through the Service.
- you retain ownership of your User Content
- by using the Service, you grant us a limited, non-exclusive license to process, store, and transmit your User Content solely as necessary to provide and improve the Service
- you are solely responsible for the accuracy and legality of your User Content
- we do not claim ownership of your User Content and will not use it for advertising or sell it to third parties
We may delete User Content in accordance with our data retention practices or if we reasonably believe it violates these Terms.
AI features
The Service may include AI-powered features that generate content such as routine suggestions, effort ladders, and other structured outputs. These features are powered by third-party AI providers (currently Anthropic).
- AI-generated outputs are provided for informational and convenience purposes only and should not be relied upon as professional, medical, fitness, or other expert advice
- you are responsible for reviewing and editing any AI-generated content before relying on it
- we do not guarantee the accuracy, completeness, or suitability of AI-generated outputs
- limited routine-related data may be sent to third-party AI providers to generate responses; see our Privacy Policy for details
Acceptable use
You agree not to:
- use the Service for any unlawful purpose or in violation of any applicable local, state, national, or international law or regulation
- interfere with or disrupt the Service or servers or networks connected to the Service
- attempt to gain unauthorized access to the Service, other user accounts, or computer systems or networks connected to the Service
- reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App, except to the extent permitted by applicable law
- use the Service to transmit any malware, viruses, or other harmful code
- use any automated means (bots, scrapers, crawlers) to access the Service without our prior written consent
- circumvent or attempt to circumvent any access controls, rate limits, or security measures of the Service
- use the Service in a manner that could damage, disable, overburden, or impair it
- impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity
We reserve the right to suspend or terminate your access to the Service if we reasonably believe you have violated these Terms.
Intellectual property
The Service, including its design, features, code, graphics, logos, trademarks, and all other content provided by Mayday (excluding User Content), is owned by or licensed to Mayday and is protected by copyright, trademark, and other intellectual property laws.
These Terms do not grant you any right, title, or interest in the Service or our intellectual property, except for the limited right to use the Service in accordance with these Terms.
The Mayday name, logo, and related marks are trademarks of Mayday. You may not use them without our prior written consent.
Third-party services
The Service integrates with or relies on third-party services, including but not limited to Supabase, Anthropic, Sentry, PostHog, RevenueCat, and Apple. Your use of these third-party services is subject to their respective terms and privacy policies.
We are not responsible for the availability, accuracy, or practices of any third-party service. Links to third-party websites or services do not constitute endorsement.
Disclaimer of warranties
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to:
- implied warranties of merchantability, fitness for a particular purpose, and non-infringement
- warranties that the Service will be uninterrupted, timely, secure, or error-free
- warranties regarding the accuracy or reliability of any information obtained through the Service
- warranties that defects will be corrected
Some jurisdictions do not allow the exclusion of certain warranties. In such cases, the above exclusions apply to the fullest extent permitted by applicable law.
Limitation of liability
To the fullest extent permitted by applicable law, in no event shall Mayday, its officers, directors, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, loss of goodwill, or other intangible losses, arising out of or in connection with:
- your use of or inability to use the Service
- any unauthorized access to or alteration of your data or transmissions
- any third-party conduct or content on the Service
- any content obtained from the Service, including AI-generated outputs
Our total aggregate liability for all claims arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) fifty US dollars ($50).
Some jurisdictions do not allow the limitation or exclusion of liability for certain damages. In such cases, our liability shall be limited to the fullest extent permitted by applicable law.
Indemnification
You agree to indemnify, defend, and hold harmless Mayday and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:
- your use of the Service
- your violation of these Terms
- your violation of any third-party rights
- any User Content you create or submit through the Service
Termination
You may stop using the Service at any time by uninstalling the App and ceasing to access the Website. If you have a subscription, you should cancel it through the platform app store before uninstalling to avoid continued billing.
We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice. Upon termination:
- your right to use the Service ceases immediately
- we are not obligated to retain your User Content, though local data on your device remains until you remove it
- provisions that by their nature should survive termination will survive, including intellectual property, disclaimer of warranties, limitation of liability, indemnification, and governing law
Governing law and dispute resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.
Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution through binding arbitration or in the courts of competent jurisdiction in the State of Delaware.
You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action, class arbitration, or other representative proceeding.
Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date at the top of this page and may provide additional notice through the App or Website where appropriate. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
Entire agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mayday regarding your use of the Service and supersede all prior agreements, understandings, and communications, whether written or oral.
